第一部以版權為中心的近代中國社會史 爬梳零碎史料 揭露晚清至民初的作者、出版商如何抵制盜版「什麼是書？誰有權複製？誰又真的擁有？」即便電子書、有聲書、各種影音平臺日趨受讀者青睞的現代，這些疑問仍存於大眾心中！ 作者試圖從知識體系、文化產業結構、政治法律權威等不同面向探討中國近代的版權發展脈絡，引領讀者深思在這趟影響東亞內部的跨文化交流與知識概念的全球史之旅中，對中國的書籍出版產業帶來甚麼樣的撼動與影響！1903年商務印書館與嚴復簽訂第一份有系統的版權合約 智慧財產權自此萌生中國自古以來，對於書籍所有權的概念，皆認為是歸屬於出資製作雕版的人，與西方保護作者智慧財產的觀念十分不同，大部分的作者甚至認為書籍在完稿後就不是屬於自己的，如能藉此獲得少少的報酬已是萬幸。 清末民初西學東漸，人們對新知的渴求，令西學書籍熱銷，書商、印刷商都想分杯羹，巨大的商業潛力令各式版本一時間湧入市面，分不清正式版權歸屬哪方。當時的作者受西方版權概念啟發，覺醒到自己腦力勞動的成果正被瓜分，而自身並未獲益，生活無以為繼，開始想方設法捍衛權利。「利潤」促使書商與作者團結起來，為版權正名發聲，近代中國的版權正義由此開展。 出版商成立公會賦予書籍正版身分、僱用偵探偵緝盜版、設下線人埋伏、召開裁決大會……。在缺乏有力的法律之時，建立起規範與秩序，藉此保護書籍，從而改變了中國對版權的概念。 王飛仙教授大量挖掘檔案史料，揭露版權觀念如何吸收中國的思想與習慣，在帝國晚期過渡為現代國家之際，以開創的精神不斷試探，並提到中共建國後，版權觀念究竟又有如何不同。本書從1890～1950年各界對版權的理解與實踐面向切入，探索文化產業、知識體系與法律規章在中國的大轉變。本書特色： 1. 從現代中國社會史拉出版權史、著作權史，就晚清至1950年代著墨，看中國在版權方面如何從中掙扎、轉變到成長，一步步走到今日。借鏡他人同時可反思臺灣本身的版權史及現況。 2. 看到中國與西方對版權所有全然不同的概念。西方保障的是作者精神與智慧的「創作」；而中國則認為是擁有書籍的印刷刻版以及文稿的人。 3. 透過報紙廣告、書籍的權頁、版權憑摺、學部官報、盜版書等非傳統法律史的研究史料，以這些日常生活中人人都會碰到的物品，幫助讀者更容易了解版權。
