Indigenous Intellectual Property ─ A Handbook of Contemporary Research

This work gathers international, interdisciplinary contributors in law, intellectual property, human rights, law and technology, and artist representation and management. They examine legal and policy controversies related to protecting Indigenous intellectual property, in the context of the United Nations Declaration on the Rights of Indigenous Peoples; other documents and organizations considered include the TRIPPS Agreement, the World Intellectual Property Organization, and the World Indigenous Network. They touch on issues of cultural heritage, marketing, science and technology, and social justice, and offer case studies from around the world; many cases are from Australia and New Zealand. The book contains sections on international, copyright, trademark, and patent law, as well as privacy law and identity rights. The final section explores regional perspectives of Indigenous intellectual property. Some specific topics addressed include films using Indigenous content, resale of Indigenous Australian art, biopiracy in Europe, Indigenous knowledge and the patent system, and racial discrimination law as a means of protecting collective identity.
