欒信杰，1965年10月生，山東濰坊人。中國計量學院經濟與管理學院教授，浙江省哲學社會科學重點研究基地——浙江省產業發展政策研究中心教授，浙江省高校人文社科重點研究基地(標準化與知識產權管理)教授，碩士生導師，浙江省國際貿易學會理事，浙江省經濟學會理事，教育部人文社科重點研究基地——對外經濟貿易大學中國WTO研究院高級研究員。在歐美刊物Journal of World Trade，The Journal of World Investment & Trade，Global Trade and Customsoms Journal，The Colorado Journal ofInternational Environmental Law and Policy及國內《國際貿易》、《國際貿易問題》、《國際經貿探索》等發表中英文論文60余篇，12篇論文被SSCI、IFLP、ISTP、ISSHP、人大報刊復印資料等收錄或全文轉載；主持完成浙江省社科規劃重大招標課題1項，承擔浙江省高校人文社科重點研究基地課題1項；現已出版著作和教材3部。

反傾銷措施僅應適用于《GATT 19949第6條所規定的情況，并應依照世界貿易組織（WTO）《反傾銷協定》的規定發起和進行反傾銷調查。
《GATT 19949第6條（“反傾銷稅和反補貼稅”）規定了實施反傾銷措施的一般前提條件，即傾銷及其損害之間存在因果關系（a causal relationship existing between dumped imports and injury thereof）。所以對進口產品實施反傾銷措施只能在滿足這樣的條件下進行。簡言之，沒有傾銷、沒有由傾銷所造成的損害即不能采取反傾銷措施。但在我國的現行《反傾銷條例》第56條中，規定除因傾銷及其損害可以采取反傾銷措施之外，“任何國家（地區）對中華人民共和國的出口產品采取歧視性反傾銷措施的，中華人民共和國可以根據實際情況對該國家（地區）采取相應的措施（即對該國進口產品也報復性地采取反傾銷措施——筆者注）。”這是我國適用反傾銷制度的特殊情況。當然，也因其不符合上述世界貿易組織（WTO）反傾銷規則及世界貿易組織（WTO）貿易爭端解決機制下的貿易報復規則而受到世界貿易組織（WTO）其他成員的質疑，其操作性也受到很大的限制。
二、“損害”的定義及其認定（Definition of Injury and Determination Thereof）
The definition of injury under the WTO antidumping rules is a broad one.It is taken to mean material injury to a domestic industry，threat of material injury to a domestic industry or material retardation of establishment of such an industry.
世界貿易組織（WTO）反傾銷規則所定義的“損害”是一個廣義上的“損害”。它是指對一個國內產業造成嚴重損害、嚴重損害威脅，或實質性地阻礙這樣一個國內產業的建立。
這個損害定義涉及四個概念：1.國內產業；2.嚴重損害；3.嚴重損害威脅；4.實質性地阻礙國內產業的建立。
1.國內產業（Domestic Industry）
國內產業可由產品范圍或地域范圍來定義。合理確定“國內產業”的產品范圍和地域范圍是反傾銷中的一個重要問題，產品范圍和地域范圍的大小對認定“損害”成立與否有著實質性的影響。
