The exercise of discretion in criminal justice is difficult to define and, hence, quite contentious, especially in the areas of gatekeeping (pushing people into or out of the criminal justice system or other controlling agencies). Aiming to provide a descriptive understanding of the uses of discretion, Gelsthorpe and Padfield (both of the Institute of Criminology, U. of Cambridge, UK) present nine papers that look at such topics as the use of police discretion with youthful offenders, discretion in sentencing, prisoner liability to discretionary powers, and the impact of discretion on mental health and asylum seekers. Although the authors focus largely on the UK context, parallel debates in the US and elsewhere make the theoretical discussions contained here more broadly pertinent. Distributed in the US by ISBS. 作者簡介
Loraine Gelsthorpe
is a University Senior Lecturer at the Institute of Criminology, and a Fellow of Pembroke College, University of Cambridge.Nicola Padfield is Senior Lecturer in Law at the University of Cambridge, and has published widely on criminal law, sentencing and criminal justice. She sits as a Recorder in the Crown Court, and has been editor of Archbold News since 1996.
