本計畫是在一個修正《水利法》及建構新水法構想框架下的研究的一部分。縱向回顧性的研究，包括過去的研究成果，如：整理水利法的立法過程及在台灣地區的施行過程、水利法條文歷次修正理由、水利法解釋函令的整理、水利法相關訴訟整理。本計畫延續此方向，完成水利法施行細則的解釋函令整理及水利法相關訴訟後續整理；同時，橫向的參考其他國家水法的修法過程及背景因素，以及探討與我國環境法中與水利工作相關的議題，為未來修正水利法及新訂相關法律建立基礎。
This project is a part of a series of research that studies the structure of promulgation of the Water Act and legislation of other new Water law. It started at finding the history of legislation of the Water Act and its enforcement in Taiwan. Then, promulgation history and reasons related, interpretations to the articles and litigation cases about the Act are coordinated in the last year. In this year, interpretations to the articles of the Enforcement Rules for Water Act are collected, promulgation process and reasons of water laws of other nations are referred, and water related issues in environmental laws are discussed.
